Une association peut-elle être à but lucratif ? Si oui, dans quels cas et quelles en sont les restrictions ?

Bien sur que oui, il en existe des dizaines...!
Même s'il ne s'agit pas d'une catégorie juridique distincte, les associations peuvent avoir un but lucratif. Le but non lucratif signifie que l'association ne peut pas distribuer les bénéfices aux membres de l'association, cela ne lui interdit pas d'en réaliser. Le but lucratif de l'association est donc constaté au vu des activités réelles du groupement. La fiscalité appliquée à l'association sanctionne alors le fait qu'elle sorte du cadre définie par la loi de 1901. La fiscalité applicable se rapproche de celle des entreprises.
A priori, une association est à but non lucratif. Mais son régime fiscal peut être requalifié par l'administration fiscale, ou un tribunal, en association à but lucratif. Elle perd alors ses avantages fiscaux, se retrouve pratiquement avec les astreintes fiscales des sociétés commerciales mais ATTENTION : elle conserve le statut juridique d'association et donc la capacité juridique restreinte.
